Disciplinary Actions - March-April 2017

Nine notaries in six counties were disciplined recently by the Secretary of the Commonwealth for violations against the Pennsylvania Notary Public Law.
 

Allegheny County

A Coraopolis notary permanently and voluntarily surrendered her commission because she failed to require personal appearance of her customers.

 A notary in Pittsburgh permanently and voluntarily surrendered her commission because she failed to know through personal knowledge or have satisfactory evidence that the person appearing before her was the party who executed the mortgage.
 

Berks County

A Reading notary was suspended for 18 months, stayed in favor of probation, for failure to require personal appearance of customers and maintaining an accurate register. She was assessed a civil penalty of $400 and $900 in probation assessment fees. In addition, she must successfully complete a notary education course during her probation.
 

Butler County

A notary in Butler was suspended for three months, stayed in favor of probation, and assessed a civil penalty of $250 and $150 in probation assessment fees for failing to maintain an accurate register and imposing fees in excess of those set by the Secretary. She must successfully complete a notary education course during her probation.
 

Chester County

A West Chester notary was suspended for three months, stayed in favor of probation, for failing to complete the commissioning process. She did not record her bond or take the oath of office and continued to perform notary acts. She also failed to maintain an accurate register. She was assessed a civil penalty of $250, which was stayed in favor of the successful completion of a notary education course. She must also pay $150 in probation assessment fees.
 

Cumberland County

A notary in Enola who failed to complete the commissioning process and continued to perform notary acts, was suspended for three months, which was stayed in favor of probation. She also failed to maintain an accurate register and was assessed a civil penalty of $250 and probation assessment fees of $150. She must successfully complete a notary education course during her probation period.

In Camp Hill, a notary was suspended for three months, stayed in favor of probation, for failing to complete the commissioning process and continuing to perform notary acts. He also failed to maintain an accurate register. He was assessed a civil penalty of $250 and probation assessment fees of $150 and must successfully complete a notary education course.

A Shippensburg notary permanently and voluntarily surrendered her commission because she failed to keep and maintain custody of her register.
