Disciplinary Actions - September-October 2016
Two notaries in two counties were disciplined by the Secretary of State for infractions of the Notary Public Law.
Dauphin County
A notary in Highspire permanently and voluntarily surrendered his notary commission because he failed to maintain custody of an accurate chronological register. He also failed to be familiar with the duties and responsibilities of a notary.
Philadelphia County
A Philadelphia notary had her notary commission suspended for six months, three of which were stayed in favor of probation, because she failed to include the required language for a verification, affidavit, acknowledgment and acknowledgment by an attorney-atlaw on an assignment of bail. She also failed to know through personal knowledge or have satisfactory evidence that the person appearing before her was the party who executed the agreement. In addition, she failed to maintain an accurate chronological register. The notary was ordered to attend and successfully complete a six-hour notary education course and pay a civil penalty of $500 and probation assessment fees of $300.
