Disciplinary Actions - May/June 2018
Five notaries in three counties were disciplined by the Secretary of the Commonwealth for violations of the Notary Public Law.
Crawford County
A notary from Titusville had her notary commission revoked based on findings she failed to properly identify a customer appearing before her. The notary failed to keep and maintain custody and control of an accurate chronological register of all notarial acts and was not of sufficient ability to hold the office of notary public.
Montgomery County
A Norristown notary had his commission suspended for three months, which was stayed in favor of probation, and must complete a six-hour notary educaiton course. In addition, he must pay a civil penalty of $250 and probation assessment fees of $150. The notary engaged in incomplete or improper notarizations by failing to include essential notary language and failing to maintain an accurate notary register.
Philadelphia County
A Philadelphia notary was suspended for six months, is required to complete six hours of notary education and then serve probation for another six months for failing to maintain a notary register. He also failed to require personal appearance; allowed others to access his notary stamp and lacked sufficient ability to serve as a notary public.
A second notary from Philadelphia surrendered his notary commission permanently because he submitted an application that contained an omission of fact by answering "no" to ever having been convicted of two counts of first degree misdemeanors. He failed to be familiar with the duties and responsibilities of a notary public and failed to be of good character, integrity and ability.
A third notary from Philadelphia permanently surrendered her commission because she failed to properly identify a customer appearing before her. She failed to maintain an accurate notary register and failed to include essential notary language on a letter.
