Legislative Update for Motor Vehicle Agents
Act 78, House Bill 1161 - Enacted December 17, 2015, Effective 60 days:
The state Board of Vehicles Act limits licensed vehicle salespersons to sell for only one dealer at a time. Under existing law, a salesperson licensed to one dealership cannot work at another one of the same dealer's facilities, even if that other facility is next door.
This legislation allows vehicle salespersons licensed to one dealership to legally sell at another related dealership, provided the other facility possesses common (but not necessarily identifical) ownership. State law already permits this practice in circumstances when the ownership of both facilities is identical.
The state's vehicle dealers support this legislative change.
Act 79, Senate Bill 398 - Enacted December 17, 2015, Effective 60 days:
Redesigns driver's license and identification card applications to include the question "Do you wish to have organ donor designation printed on your driver's license." This question, although it is required to be asked, is not printed on all driver's license/identification forms. the legislation also requires a phrase to be added to all forms stating that "Pennsylvania strongly supports organ and tissue donation because of its life-saving and life-enhancing opportunities."
Act 86 of 2015, House Bill 1195 - Enacted December 20, 2015, Effective 60 days:
Enables financiers to allow consumers to finance a recreational vehicle for up to 20 years, without requiring renewal with the Commonwealth. Act 89 had perfection of security interest included for mobile homes, emergency vehicles, trucks and trailers. This legislation now includes recreational vehicles.
