Act 91 Addresses Vehicle Transfers to Scrap Metal Processors

Effective September 18, Act 91 of 2016 eliminates the notarization requirement for a certificate of title or certificate of salvage when the vehicle is transferred to a scrap metal processor.

The Act also allows any insurer to apply directly to the Pennsylvania Department of Transportation (PennDOT) for a certificate of title or certificate of salvage if a certificate has not been provided to the insurer by the insured within 30 days of settling a claim.

An owner who transfers a vehicle or a salvage vehicle to a scrap metal processor must assign the certificate of title or certificate of salvage to the scrap metal processor; however the certificate is exempt from the notarization requirement.

The scrap metal processor is required to send the assigned certificate to PennDOT along with a form indicating that the vehicle is to be designated as a non-repairable vehicle. Non-repairable vehicles cannot be reconstructed or retitled.
