Disciplinary Actions - May/June 2019
Two notaries in two counties were disciplined by the Department of State for violations against the notary public law.
Erie County
An Erie notary had her commission revoked based on findings she failed to be of good moral character and integrity. In her 2015 notary application, she failed to cite that she pled guilty to forging checks, a felony in the second degree. In addition, she stole motor vehicle forms and used dealership credentials to transfer a vehicle.
York County
A Dillsburg notary had her notary commission suspended for 12 months, which was stayed in favor of probation and had to successfully complete a six-hour notary education course for failing to know through personal knowledge or satisfactory evidence that the person appearing before her was the person described in and executing the document. She failed to require personal appearance and failed to include all of the essential notarial language on an "Affidavit of Occupancy," and recorded complete drivers' license numbers in her register (journal). She was ordered to pay a civil penalty of $500 and probation assessment fees of $600.
